Privacy Policy
This privacy policy applies to our website Imagemo and all our related websites, software applications, mobile apps, plugins, and other services we offer (collectively referred to as the "Service").
The purpose of this policy is to explain how we and our affiliates collect, use, share, and protect the information you provide when accessing and using the service. It also outlines how you can exercise your privacy rights. If you have any questions, suggestions, or concerns about how we handle your personal information or this privacy policy, please don't hesitate to reach out to us using the contact details provided at the end of this document.
Personal Information We Collect
Information You Provide to Us Directly
Certain areas of our service may ask you to voluntarily provide personal information, such as your first and last name, date of birth, gender, city and country of residence, personal details, PayPal email address, online profiles, uploaded media content, and email address. Any information you provide will be displayed on your public Imagemo profile page and can be edited or removed by you at any time.
We also collect any personal information contained in messages you send to us and other users through our service (such as feedback, messages, and search queries) and personal information in content you upload (like photos, videos, and associated metadata). We use this information to operate, maintain, and provide the features and functionality of our service, to communicate with you, and to address any issues or inquiries you may have. Please note that you must not upload photos or other content containing personal data of third parties without their express consent.
If you don't share your information with us, you may be unable to access or utilize certain service features, or your experience using the service might not be as enjoyable.
We may receive information about you from third parties. For instance, when you log into the service using a third-party account (such as Facebook), we may also collect certain information from that third party necessary to authenticate your account, like your email address and any other details you permit the third party to share with us. You should always review and, if necessary, adjust your privacy settings on third-party websites and services before linking or connecting them to our service. You can also unlink your third-party account from our websites by adjusting your settings on the third-party service. If you unlink your third-party account, we will no longer receive information collected about you in connection with that service.
Collect information automatically
We automatically collect or generate certain information about your service use (such as user activity data, analytics event data, and clickstream data) for data analytics machine learning and to help us measure traffic and usage trends for the service. We may also use third-party analytics tools that automatically collect information sent by your browser or mobile device, including the pages you visit and other details that assist us in improving the service. For more information, please refer to the sections below on cookies, log file information, clear gifs, device identifiers, and location data.
Cookie information & similar technologies
When you visit our service, we (and our third-party partners) send cookies - small text files with a string of characters - to your computer. These cookies uniquely identify your browser and allow us to do things like speed up your log-in, enhance your site navigation, remember your preferences, and generally improve your user experience. Cookies also convey information to us about how you use the service (e.g., the pages you view, the links you click, and other actions you take) and allow us or our business partners to track your usage over time. They also help us measure traffic and usage trends, deliver personalized ads that may interest you, gauge their effectiveness, and find potential new Service users.
You can control or reset your cookies and similar technologies through your web browser settings. These settings allow you to customize your cookie preferences and refuse or be notified of all cookies. However, some Service features may not function properly if cookies are disabled. For more details on how we use cookies and other technologies and how to control them, please read our Cookies Policy.
Log file data
Your browser or mobile device automatically reports certain log file information whenever you access our service. Our servers automatically record details from these log files when you use our service. This recorded data may include anonymous information like your web requests, browser type, referring/exit pages and URLs, number of clicks, how you interact with links on the service, domain names, landing pages, pages viewed, and other details.
When you use our service, we may utilize clear GIFs (web beacons) to track how our users browse and interact online anonymously. Additionally, we may incorporate clear GIFs in HTML-based emails sent to users to see which emails get opened and which links get clicked by recipients. This data allows us to report more accurately and enhance the service.
Device identifiers
When you access our service on a mobile device like a smartphone or tablet, we may access, collect and monitor one or more "device identifiers," such as a universally unique identifier (UUID). Device identifiers are small data files that uniquely identify your specific mobile device. A device identifier can provide us with information about how you use the service. It may remain persistently on your device to help you log in and navigate the service more efficiently. Some service features may fail if device identifiers are impaired or blocked.
Location Data
We gather location data for various reasons to understand where our users are based. We may obtain your precise or approximate location in the following ways:
- Directly from you when you provide, correct or confirm your location (e.g., when purchasing products);
- By inferring your location from your IP address; and
- From our third-party partners.
How We Use Your Information
We utilize the information we collect about you for the following purposes:
Providing the Service to You: We use the information you provide to deliver the service. This includes allowing you to log in, operating and maintaining the service, and giving you access to your content. We may also use information automatically collected about you to remember details so you don't have to re-enter them during your current visit or the next time.
Data Analytics: We leverage information about you to help improve the service and overall user experience, including by monitoring aggregate metrics like total visitors, traffic patterns, and demographic trends.
Analytics and Machine Learning: We may analyze your activity, content, and related account data to provide and customize the service, as well as to train our algorithms, models, products and services using machine learning techniques. This allows us to develop, improve and deliver our Service offerings. If you prefer not to use your content for machine learning purposes, you can opt-out by updating your preferences in your account settings anytime. These analytics and machine learning activities include, but are not limited to:
- Labelling and detecting components in images (e.g., backgrounds, eyes)
- Labelling raw data elements (e.g., "man with dog")
- Detecting prohibited content per our Terms for moderation and security (e.g., pornography, copyrighted material)
- Translating audio soundtracks
- Predicting the most relevant product offerings to tailor communications and advertising
- Analyzing search terms and result interactions to build algorithms for delivering the most relevant content
Customizing Your Experience: We may use and combine the information you directly provide us, the data we automatically collect about you, and information we receive from other sources (both on and off our service) along with data about the behaviour of other users. This allows us to customize and tailor the service to your needs and preferences. For example, to recommend content likely to be helpful to you, we may leverage your prior activity on our service, how other people use content and other inferred insights.
Communicating About the Service: We may use your contact information to communicate with you and send you communications about critical Service elements. For instance, we might email you about technical issues, security alerts, or administrative matters related to the service.
Promoting Engagement: We may use your contact information to reach out about participating in our surveys or to highlight Service features and offers that we think you'd be interested in. We also use information about you to ensure you receive the most relevant promotions based on your Service usage and preferences.
Improving the Service: We analyze data about how you use the service and interact with your content. This helps us better understand user engagement patterns and measure the service's effectiveness so we can make improvements and develop new offerings.
Advertising Purposes: We may use information about you, including cookies and other automatically collected data about your Service usage, to deliver, personalize, and measure advertising effectiveness on our Service and third-party sites/platforms. This includes showing ads we think you might find exciting and displaying ads to potential new users with similar interests. For more details on how we use your information for advertising, please see the "Advertising" section below.
Customer Support: We use information about you, data from your account, details you provide our customer service team, and records of your Service interactions to resolve any technical issues you experience and ensure we can repair and improve the service for all users.
Security Measures: We use information about you and your account activity to monitor for suspicious or potentially fraudulent behaviour and identify violations of our Privacy Policy or Terms of Service.
Troubleshooting, Error Resolution and Improvements: We may need to review your content or information to support your request for assistance, correct general Service errors, or improve our offerings.
Legal Obligations: We will use or disclose your information if we reasonably believe such action is necessary to (a) comply with the law and legitimate requests from law enforcement; (b) enforce our Terms or protect the security and integrity of our service; and (c) exercise or protect the rights, property, or personal safety of Imagemo, our users, or others.
Legal Basis for Processing Personal Information
If you are located in the EEA, Switzerland or the UK, we require a legal basis to collect, use and disclose your personal information. Our lawful basis will depend on the specific information and context in which it is processed.
Generally, Imagemo will collect and use your information as follows:
Contractual Necessity: We need it to provide the service to you and fulfil our obligations under our Terms of Service. This includes creating and maintaining your account, resolving Service issues, and providing access to your content.
Legitimate Interests: It is necessary for our legitimate business interests, such as providing a valuable and customized Service, sending relevant marketing messages, displaying advertising and tracking effectiveness, using your data (like usage and search terms) to make more informed decisions and offers for our users, helping connect our community, and enhancing our service via research, analytics, labelling, machine learning and predictive analysis on usage data. We do not rely on this basis where your rights and interests outweigh our legitimate interests.
Consent: You consent to us and our third-party partners using your information in specific ways, such as to receive new feature/offer updates and for machine learning and predictive analysis of your content.
Legal Obligations: It is necessary to comply with legal requirements - for instance, disclosing information in response to law enforcement requests and retaining records.
If you have consented to our use of your information, you can withdraw that consent at any time. Depending on the situation, you can withdraw consent by emailing info@Imagemo.com or through the settings page in your account.
When we use your information based on our legitimate business interests, you have the right to object to that use by contacting info@Imagemo.com. However, if you do object, it may diminish the quality of the service you receive or prevent you from using some or all of the Service features.
Sharing Your Information
We respect and are committed to protecting your privacy.
However, we may disclose your personal information to our group companies, service providers, and partners who provide data processing services for us, for example, to support delivering our websites, providing functionality, or helping enhance security. We may also share your data with parties that process it for purposes described in this privacy policy or notify you when we collect your data.
In the event of a proposed purchase, merger or acquisition of any part of our business, we may disclose your personal information to the actual or potential buyer (and their agents/advisors). However, we will inform the buyer that they must use your personal information only for the purposes disclosed in this privacy policy.
We may also aggregate or anonymize data by removing all personally identifying details and sharing that anonymized, aggregated data with third parties.
We reserve the right to disclose your personal information as legally required (e.g., to comply with subpoenas, warrants, or court orders) and when we believe disclosure is necessary to protect our rights, avoid litigation, ensure your safety or the safety of others, investigate fraud, and respond to government requests. We may also disclose information about you if we determine such disclosure should be made for national security reasons, law enforcement purposes, or other issues of public importance.
If you consented to us disclosing your personal information to any other third party, we may share the data with them.
How do we transfer, store, and protect your information?
Your information will be stored and processed in the United States, Australia, Singapore, the European Union, the United Kingdom, the Philippines, New Zealand, and other countries where Imagemo, our group companies, service providers, and partners maintain facilities or employ staff/contractors.
This means your data may be transferred to and processed in countries other than your location. These countries may have data protection laws that differ from the laws of your country (and, in some cases, may not be as protective).
However, we always take steps to ensure your data remains protected in accordance with this privacy policy and applicable data protection laws. These measures include transferring your data to countries the European Commission or UK authorities (as applicable) have determined to provide adequate protection or implementing standard contractual clauses with our group, service providers, and partners.
Keeping Your Information Safe
We take commercially reasonable security measures designed to protect the security of personal data, including safeguards against unauthorized or unlawful processing and against accidental loss, destruction or damage. We use appropriate technical and organizational measures for this protection. To protect your privacy and security, we take reasonable steps (such as requiring a unique password) to verify your identity before granting access to your account. You are responsible for keeping your unique password and account information secure and confidential and controlling access to your account at all times. However, we cannot ensure or warrant the security of any information you transmit to us or guarantee that information on the service will not be accessed, disclosed, altered, or destroyed despite our efforts.
Your Rights
You have the right to access the data we process about you, obtain rectification of inaccurate data, request deletion of your data, restrict our processing of your data, request portability of your data, and object to unreasonable processing. If we process your data based on your consent, you can withdraw your consent at any time. Withdrawing consent will not affect the lawfulness of the processing we carried out before your withdrawal.
You can exercise any of these rights by contacting us using the details provided under the "Contact Us" heading at the bottom of this page. We respond to all requests in accordance with applicable data protection laws. In some cases, we may be unable to comply fully with your request regarding your personal data. If so, we will explain why.
You can also opt out of our marketing communications at any time. To unsubscribe, click the "unsubscribe" or "opt-out" link in the marketing emails we send you or change your profile settings. By updating your account settings, you can opt out of having your content used for machine learning. If you have any questions, please get in touch with us using the "Contact Us" details on the page.
If we fail to solve your problem or you're worried about a potential violation, you can also report it to the data protection authority in your jurisdiction.
The data retention policy
We will keep your personal data as long as your account remains active or until it is necessary to continue providing you with our services. We will also keep it as required to comply with our legal obligations, resolve disputes, and enforce our agreements.
The key points are preserved, but the language aims to be clear, conversational and efficiently understandable without legalese. The tone stays straightforward in outlining the options for users.
When we no longer have an ongoing legitimate business need to process your information, we delete or anonymize it. Suppose deletion is impossible (for example, because your data has been stored in backup archives). In that case, we will securely store your information and isolate it from any further processing until deletion becomes possible.
Children
As stated in our Terms, children may not access or use our Services unless they are directly authorized by a parent, legal guardian, or other authorized adult who agrees to be bound by the Terms. For these Terms, a child is defined as a person under 13 years old (or the minimum legal age to provide consent for processing personal data in their country of residence, with 16 being the minimum in Germany).
Our service and content are not directed at children. Children are not permitted to sign up for the service on their own. We do not knowingly collect or solicit personal information from children. If we learn that we have collected a child's personal information without verifying parental consent where required, we will delete that information as quickly as possible.
Third-Party Service-Based Information
Imagemo participates in the Amazon Services LLC Associates Program, an affiliate advertising program designed to allow sites to earn advertising fees by advertising and linking to Amazon.com.
Advertising
We partner with third-party ad servers, ad networks, and social media platforms (like Facebook, Instagram, Google, Amazon Associates, and BuySellAds) to deliver personalized advertisements ("ads") on our service and other sites that may be relevant to your interests, and to measure their effectiveness, and to identify potential new Service users.
We may share certain information with our third-party ad partners, such as your email address, location, cookie data, and details about your use of our service. We allow partners to match your information against data from other third-party networks or sites in order to show you ads either on our service or on third-party sites (including, but not limited to, Facebook and Google) and to measure the effectiveness of these ads. We also share certain information with social media platforms like Facebook and TikTok to display ads to potential new users whose demographics and behaviours are similar to our existing user base.
Additionally, these third-party ad servers or networks may use technology to send personalized ads and ad links directly to your browser or mobile device and will automatically receive your IP address when they do so. They may also use other technologies (such as cookies, JavaScript, device identifiers, location data, and clear gifs) to compile information about your browsing or device usage patterns on our service to measure ad effectiveness and personalize the advertising content. Please see our Cookies Policy for more details on how we and our third-party partners use cookies and other technologies to deliver ads to you.
We do not sell or rent the information we collect about you to these third-party ad servers or networks for their marketing purposes.
Please note that an advertiser may ask us to show an ad on our service to a specific audience (e.g., based on demographics or other interests). In those situations, we determine the target audience and serve the advertising to that group, only providing anonymous aggregated data to the advertiser. If you respond to such an ad, the advertiser or ad server may conclude that you fit the description of the audience they aimed to reach.
The Imagemo Privacy Policy does not apply to third-party advertisers; we cannot control their activities. Please consult the respective privacy policies of such advertisers or contact them directly for more information.
Changes to This Policy
We may update this privacy policy from time to time to reflect our current practices and ensure compliance with applicable laws. When we make changes, we will revise the "Last Updated" date at the top of the policy. If we make any material changes to how we collect, use, store and share your personal data, we will take appropriate steps to notify you. We recommend periodically checking this page to stay informed of any updates or changes.
